situations that infringe on the rights of other students; situations causing significant disruption to the educational community or detrimental to the educational mission of the college. Proceedings under the Student Code of Conduct may occur before, during, or after civil or criminal proceedings and are independent of those processes. Misconduct that violates Federal, State, local laws, or Beacon College policy will be considered a violation of this policy and will be investigated and adjudicated through the College conduct system using its standard of proof. A lack of conviction in a criminal proceeding will not serve as evidence in a College conduct proceeding. Determinations and sanctions from College disciplinary proceedings will not be altered due to criminal charges being dismissed, reduced, or resolved in favor of or against a criminal defendant. The Student Code of Conduct may be applied to behavior conducted online, via email, or another electronic medium. Students should also be aware that online postings are in the public sphere and are not private. These postings can subject a student to allegations of conduct violations if evidence of policy violations is posted online. The Student Code of Conduct applies to guests of community members whose hosts may be held accountable for the misconduct of their guests. Visitors to and guests of the college may seek resolution of violations of the Student Code of Conduct committed against them by members of the college community.
